Kenyan Citizenship by Registration: When Your Spouse Dies

By Agweyu Collins - 10/19/2026

What if my Kenyan spouse has died? Can I still apply for Kenyan Citizenship by Registration?

Section 12 of the KCIA protects widows and widowers.

If a foreign spouse's Kenyan husband or wife dies before the seven years are complete, the surviving spouse is treated as lawfully present for the rest of that period and may apply for registration once it ends.

Marrying a non-citizen before the period ends removes this protection.

Important to note is that Citizenship acquired by registration can be revoked under Article 17 of the Constitution. Grounds include obtaining it by fraud, false representation or concealing a material fact, and certain criminal convictions. This is why the application must be accurate and complete from the start.
